Welcome to the National Student Health Awareness Initiative website (”the Site”) which is owned, controlled and operated by NSHAI. These Terms of Use are important and you should read them carefully. The Site may also include materials owned by third parties and posted on the Site by virtue of a license, grant or some other form of agreement between the third party and The NSHAI. We have created the Site for your information and health education However, your use of and access to the Site is conditional upon your acceptance of and compliance with these Terms of Use and the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Site, and on you complying with all applicable laws of the Commonwealth of Australia (including its states and territories). Your use of, and/or access to, the Site constitutes your agreement to these Terms of Use. The NSHAI reserves the right to amend the Terms of Use at any time. Any changes will be published in this web document. Since these Terms of Use bind you, you should periodically refer to this web document to monitor changes. Access & Use

All information, text, material, graphics, software and advertisements on the Site (”Content”) are protected by Australian and international copyright and trademark laws. Apart from any use permitted under the Copyright Act 1968 (Cth) you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way except as expressly provided for on the Site or expressly authorized in writing by The NSHAI team. The reproduction, duplication, distribution (including by way of email, facsimile or other electronic means), publication, modification, copying or transmission of material from the Site is STRICTLY PROHIBITED unless you have obtained the prior written consent of a designated official or unless it is specifically stated otherwise within the Site. The material covered by this prohibition includes, without limitation, any text, graphics, logos, photographs, audio or video material or stills from audiovisual material available on the Site. The Site contains links to other websites outside the Site for your information and convenience. NSHAI makes no warranty or representation as to the functionality of these links, the security of those sites or the reliability or accuracy of the information contained on these sites. You access any such website entirely at your own risk, this shall include the site links provided by all of our Health information Providers, Sponsors and or supporters and shall further include any links supplied by any participant in the NSHAI.

Disclaimer and limitation of liability

While The NSAI team does its best to ensure the optimal performance of the Site, you agree that you use the Site and rely on material contained in the Site at your own risk. Where any applicable legislation implies any term, condition or warranty into these Terms of Use or into NSHAI’ relationship with you or otherwise gives you a particular remedy against NSHAI (”Implied Terms”) and that legislation or any other legislation prevents the operation of provisions excluding or modifying the application of the Implied Terms, then the Implied Terms will be deemed to be included in these Terms of Use. However, NSHAI’ liability for any breach of an Implied Term will be limited, to the extent permitted by law, at NSHAI’ option, to the following: a. In the case of services supplied or offered through the Site, the supply of the services again, b. In the case of goods supplied or offered through the Site, the replacement of the goods or the supply of equivalent goods, the repair of such goods, the payment of the cost of replacing the goods or acquiring equivalent goods, or the payment of the cost of having the goods repaired. Except to the extent that the Implied Terms are included in the Terms of Use, all terms, conditions, warranties, undertakings, inducements and representations, whether express or implied, statutory or otherwise, relating in any way to the Service are excluded.

Subject to the Implied Terms:

a. The NSHAI DOES NOT WARRANT that the Site is fit for any particular purpose; that the functions contained in the materials in the Site will be uninterrupted; that defects will be corrected; that the Site is free of viruses and other harmful components or that the Content is accurate, complete or reliable. b. You should make and rely on your own enquires before entering into any transaction on the basis of the Content of the Site. c. You acknowledge that The NSHAI and related parties together with their respective employees, agents, directors, officers and shareholders, ARE NOT LIABLE for any delays, inaccuracies, failures, errors, omissions, interruptions, deletions, defects, viruses, communication line failures or for the destruction, damage or unauthorized access to your computer system or Site. d. You acknowledge that The NSHAI is not liable for any defamatory, offensive or illegal conduct or material found in connection with the Site, including such conduct or material transmitted by any means by any other person. e.You acknowledge that The NSHAI is not liable for any damages, including, without limitation, direct, incidental, special, consequential or punitive damages, in connection with or arising from your use or from your inability to use the Site. f. You expressly acknowledge and agree that The NSHAI does not exert control over users of the Site (including individuals referred to on the Site as guests and experts) and is not liable either for their opinions or their behavior including any information, advice, defamatory statements or offensive conduct.

Acceptance of The NSHAI Privacy Policy

You acknowledge and accept that your use of the Site signifies your agreement to the Privacy Policy, The NSHAI may at any time vary the Privacy Policy by publishing a revised edition on the Site. You accept that by doing this we have provided you with sufficient notice of the variation.

Contact Us

If you have any feedback you wish to provide The NSHAI in relation to this Site, you should go to the “Contact Us” link on the Site. When you “contact us”, you will be asked to provide personal information which The NSHAI handle in accordance with its Privacy Policy. In particular, The NSHAI will use your personal information for the purpose of further developing this site and informing people about its products. The personal information you provide may also be used for the purpose of sending you information regarding, health information news, future initiatives and random draws. Your consent will be sought at the time you “contact us” as to whether you would like to receive such information. Furthermore, if you wish to no longer receive such information from the NSHAI, you can elect to be removed at any time by contacting The NSHAI in writing or email.

Termination

The Terms of Use are effective until terminated by The NSHAI. The NSHAI may terminate this agreement and your access to the Site at any time without notice. In the event of termination, you are no longer authorized to access the Site, but all restrictions imposed on you, licenses and waivers granted by you and all NSHAI disclaimers and limitations of liability set out in these Terms of Use (as amended) will survive.

HOW TO ENTER COMPETITIONS

Firstly enter your unique code, found on the back of your Sunscreen purchase via your school, to enter the prize pool competitions page

Quiz: Select the Quiz relevant to your year e.g.

For years 1-7 select Primary For years 8-12 select Senior For staff select- teaching staff To enter you are required to find the answers to the questions on your age relevant quiz. You will find the first answer within the Health providers’ page on the NSHAI site (see drop down) the remaining questions can be answered by accessing the providers’ own site via the link on health pages. When you have collected all the answers simply click on ‘submit’ and you are automatically in the draw for prizes, which will include, iPod, Australia Zoo Family pass and further prizes achieved by participation in the fundraising aspect of the initiative. Ultimately every student that enters the quiz is a winner simply because on the way they have learned so much more about the topics covered, knowledge is the first step to a healthier life. The second competition requires you to use your skills to find the answers to the health awarenss quiz which has a degree of difficulty relevant to student age. To enter, students simply submit thier completed answers CONDITIONS OF ENTRY

  • Information on how to enter and prizes form part of the terms and conditions of entry. Eligible participants will be required to provide their own name, delivery address, postcode, telephone number to enable the winner to be contacted. The quiz entry must be complete with ALL correct answers and submitted via the NSHAI web site during the promotion to complete their entry. The promotion title must be provided in the entry. Incomplete or incomprehensible entries will be ineligible.
  • Entry is only open to Australian students Grades 1-12 in State, Private and Catholic Schools inclusive. Employees of The NSHAI and their immediate families, companies, participating outlets and their agencies associated with this promotion are ineligible. Teachers may only enter the teacher specific quiz. Via the competition bar.
  • The competition commences January 2010 at 00:01 (EST) and concludes on 30 April 2010 at 5:00pm. The Promoter takes no responsibility for late, lost or misdirected mail.
  • The winners will be judged by the NSHAI The winner/s will be determined based on correct entry conditions only. This is a test of skill research  and initiative chance plays no part in determining the major prize winners. Judges’ decision is final and no correspondence will be entered into. Prizes cannot be transferred. Prizes cannot be redeemed for cash. The winners will be notified by phone or email within a week from the date of judging and delivery of the prize will be organised.
  • The runners up prize will be selected on merit and each winner will be notified via phone.

Total Prize Pool value will be determined by the level of participation only. No pre set monetary rewards are in place above the initial $5000. Therefore the values of prizes 1-3 are entirely achieved by total fundraising product sales.

  • Each Hamiltons Sunscreen fundraising product code may only be used by one student to enter each of the three competitions, once only. Should a unique code be found to have multiple entries and or names attributed to it, all entries relevant to that unique code will be deemed null and void. Thereby ensuring a fair and equitable opportunity for all students.
  • Students may only submit the quiz relevant to their academic level i.e. Primary may only enter Primary - Senior/High School students may only enter their relevant quiz.
  • Prizes are non transferable or redeemable for cash.
  • All entries become the property of the promoter. All winning entries will be entered into a database and the promoter may use the winners’ names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
  • The promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any other prize/s except for any liability which cannot be excluded by law.
  • In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.
